Progress Report: United Nations Special Rapporteur In-Country Visit To Cambodia, December 4-14, 2023
The investigative in-country visit to Cambodia by Vitit Muntarbhorn, United Nations’ Special Rapporteur for Human Rights in Cambodia, which started on 4 December, was always viewed by the Khmer community, along with the Universal Periodic Review scheduled for April of 2024, as one of the key opportunities for bringing international attention to the Hun Sen/Hun Manet government’s major and ongoing campaign of human rights and rule of law abuses. That investigative visit is now taking place, and the full returns are not yet in. But even at this early date in Professor Muntarbhorn’s planned investigative trip, it is important to report that early returns indicate that our expectations and hopes have already been substantially exceeded!
The first indicator of important progress was that, following our number one principal recommendation that we made in our pre-trip submission to the Special Rapporteur, and relying on contact information we provided, he made the long-standing and substantially ignored issue of “land-grabs” and the illegal displacement by the government for development purposes of farmers and land owners, the very first issue that he gave attention to on the very first day of his visit, by meeting personally with a number of illegally displaced landowners in the Lor Peang and Koh Kong regions!
We were the only group that urged that additional attention be given to this urgent and longstanding problem as part of this in-country investigative visit. We made the land-grab issue a priority for the Special Rapporteur’s in-country visit in part because of our broader plan to make the land-grab issue the focus of a major submission we will be making to the UN Human Rights Council and the UN Special Rapporteur for Housing Rights, planned for March of 2024, in response to a “Call for Inputs/Submissions” that just was issued by the UN.
Our March response to the “Call for Inputs” on the displacement and land grab issue will include:
A comprehensive review of the numerous land grab situations that have been taking place in Cambodia over the years, many of which were well-documented by the report of the international monitoring group Global Witness;
A summary description of the most recent land grab problems, including those currently taking place in Koh Kong, Angkor Wat Archaeological Park and Mongabay Park; and,
An analysis of the significant role that the Hun Sen/Hun Manet government has played in this problem.
This work also will be a major part of our presentations and advocacy work at the Universal Periodic Review of Cambodia that will take place before the UN Human Rights Council in May of 2024.
These advocacy opportunities over the next six months that have been presented to the Khmer community by the United Nations, represent a unique chance for us to “speak truth to power,” and to present our views and concerns before the international community at the highest and most influential levels. ដំណើរទស្សនកិច្ចស៊ើបអង្កេតនៅកម្ពុជារបស់លោក វីទីត មុនតាប៊ន (Vitit Muntarbhorn) អ្នករាយការណ៍ពិសេសរបស់អង្គការសហប្រជាជាតិទទួលបន្ទុកសិទ្ធិមនុស្សប្រចាំនៅកម្ពុជា ដែលបានចាប់ផ្តើមកាលពីថ្ងៃទី៤ ខែធ្នូ រួមជាមួយនឹង «ការពិនិត្យមើលជាសកល» (Universal Periodic Review) ដែលគ្រោងធ្វើនៅខែមេសា ឆ្នាំ២០២៤ តែងតែត្រូវបានសហគមន៍ខ្មែរមើលឃើញជានិច្ច ថាជាគន្លឹះ និងជាឱកាសដ៏សំខាន់មួយឲ្យអន្តរជាតិចាប់អារម្មណ៍ទៅលើយុទ្ធនាការដ៏ធំ និងជាបន្តបន្ទាប់របស់រដ្ឋាភិបាល លោក ហ៊ុន សែន/ហ៊ុន ម៉ាណែត ស្តីពីការរំលោភសិទ្ធិមនុស្ស និងនីតិរដ្ឋ។ ដំណើរទស្សនកិច្ចស៊ើបអង្កេតក្នុងបច្ចុប្បន្នកាលនេះកំពុងប្រព្រឹត្តទៅដោយយើងមិនទាន់ទទួលបានលទ្ធផលពេញលេញនៅឡើយទេ។ ប៉ុន្តែទោះបីជាដំណើរស៊ើបអង្កេតនេះជាការស៊ើបអង្កេតដំបូងមិនទាន់ពេញលេញរបស់លោកសាស្រ្តាចារ្យ មុនតាប៊ន ក៏ដោយ ក៏វាមានសារៈសំខាន់ខ្ពស់ ដោយបង្ហាញពីការរំពឹងទុក និងក្តីសង្ឃឹមរបស់យើងច្រើនលើសលប់បានរួចទៅហើយ!។
ដំណើរការដំបូងយ៉ាងសំខាន់គឺលោក វីទីត មុនតាប៊ន បានអនុវត្តតាមអនុសាសន៍ចម្បងលេខ១របស់យើង ដែលយើងបានដាក់ស្នើមុនការធ្វើដំណើររបស់អ្នករាយការណ៍ពិសេសទៅកម្ពុជា ហើយដោយពឹងផ្អែកលើពត៌មានទំនាក់ទំនងជាមួយអ្នកនៅមូលដ្ឋានដែលយើងបានផ្តល់ឲ្យគាត់ ស្តីពីការ "រំលោភដីធ្លី" របស់ពលរដ្ឋ និងការផ្លាស់ទីលំនៅខុសច្បាប់ រៀបចំឡើងដោយរដ្ឋាភិបាលកម្ពុជា ក្នុងគោលបំណងអភិវឌ្ឍន៍កសិករ និងម្ចាស់ដី ជាបញ្ហាទី១ដែលលោក វីទីត មុនតាប៊ន យកចិត្តទុកដាក់ក្នុងថ្ងៃដំបូងនៃដំណើរទស្សនកិច្ចរបស់គាត់ ដោយបានជួបផ្ទាល់ជាមួយម្ចាស់ដី១ចំនួននៅតំបន់ ឡពាង ខេត្តក្រចេះ និងតំបន់ផ្សេងទៀតនៅខេត្តកោះកុង ដែលត្រូវគេបង្ខំឲ្យផ្លាស់ទីលំនៅ ដោយខុសច្បាប់!
យើងជាក្រុមតែមួយគត់ដែលបានជំរុញឱ្យមានការយកចិត្តទុកដាក់បន្ថែមចំពោះបញ្ហាបន្ទាន់ និងដ៏យូរអង្វែងនេះ ជាផ្នែកនៃដំណើរទស្សនកិច្ចស៊ើបអង្កេតនៅក្នុងប្រទេសកម្ពុជា។ យើងបានធ្វើឱ្យបញ្ហារំលោភដីធ្លី ក្លាយជាបញ្ហាអាទិភាពសម្រាប់ដំណើរទស្សនៈកិច្ចនៅកម្ពុជារបស់អ្នករាយការណ៍ពិសេសមួយផ្នែក ដោយសារតែផែនការដ៏ទូលំទូលាយរបស់យើងក្នុងការធ្វើឱ្យបញ្ហារំលោភដីធ្លីនេះក្លាយជាការផ្តោតអារម្មណ៍យ៉ាងសំខាន់មួយ ដែលយើងនឹងដាក់ជូនក្រុមប្រឹក្សាសិទ្ធិមនុស្សនៃអង្គការសហប្រជាជាតិ និងអ្នករាយការណ៍ពិសេសរបស់អង្គការសហប្រជាជាតិ ស្តីពីសិទ្ធិលំនៅឋាន ដែលគ្រោងសម្រាប់ ខែ មីនា ឆ្នាំ ២០២៤ ជាការឆ្លើយតបទៅនឹង "ការអំពាវនាវរបស់អង្គការសហប្រជាជាតិឱ្យមាន ការដាក់ស្នើ/
បញ្ចូលដំណឹង ពីបញ្ហាសិទ្ធិមនុស្សនៅកម្ពុជា" ។
ឆ្លើយតបទៅនឹងការអំពាវនាវរបស់អង្គការសហប្រជាជាតិដូចខាងលើនេះ យើងបានរៀបចំឯកសារ១ចំនួនទាក់ទងនឹងបញ្ហាផ្លាស់ទីលំនៅ និងការរំលោភដីធ្លី រួមមាន៖
១- ការត្រួតពិនិត្យយ៉ាងទូលំទូលាយអំពីស្ថានភាពរំលោភយកដីធ្លីជាច្រើនដែលបាននិងកំពុងកើតឡើងនៅក្នុងប្រទេសកម្ពុជាក្នុងរយៈពេលប៉ុន្មានឆ្នាំកន្លងមកនេះ ដែលភាគច្រើនត្រូវបានចងក្រងយ៉ាងល្អដោយរបាយការណ៍របស់អង្គការឃ្លាំមើលអន្តរជាតិ Global Witness ។
២- ការពណ៌នាសង្ខេបអំពីបញ្ហារំលោភយកដីធ្លីថ្មីៗបំផុត រួមទាំងបញ្ហាដែលកំពុងកើតមាននៅក្នុងខេត្តកោះកុង ឧទ្យានបុរាណវិទ្យាអង្គរវត្ត និងឧទ្យានម៉ុងហ្គាបៃ។
៣- ការវិភាគអំពីតួនាទីសំខាន់របស់រដ្ឋាភិបាល ហ៊ុន សែន/ហ៊ុន ម៉ាណែត ដែលជាអ្នកទទួលខុសត្រូវក្នុងបញ្ហានេះ។
ការងារនេះនឹងក្លាយជាផ្នែក១ដ៏សំខាន់នៃការងារតស៊ូមតិរបស់យើងក្នុងឱកាសនៃ «ការពិនិត្យឡើងវិញជាសកលលើប្រទេសកម្ពុជា» (Universal Periodic Review of Cambodia) ដែលនឹងប្រព្រឹត្តទៅនៅចំពោះមុខក្រុមប្រឹក្សាសិទ្ធិមនុស្សនៃអង្គការសហប្រជាជាតិនៅខែឧសភា ឆ្នាំ ២០២៤ ។
នេះជាឱកាសដ៏ពិសេសមួយសម្រាប់សហគមន៍ខ្មែរយើងក្នុងការតស៊ូមតិក្នុងរយៈពេលប្រាំមួយខែខាងមុខនេះ ដែលយើងនឹងបង្ហាញទៅអង្គការសហប្រជាជាតិ ជាសម្លេងពលរដ្ឋខ្មែរ ដើម្បី "និយាយពីការពិតទៅអ្នកមានអំណាច" និងដើម្បីបង្ហាញទស្សនៈ និងកង្វល់របស់យើងចំពោះសហគមន៍អន្តរជាតិដែលមានឥទ្ធិពលកម្រិតខ្ពស់បំផុត។ សូមបងប្អូនចូលរួមជាមួយយើងក្នុងកិច្ចខិតខំប្រឹងប្រែងទាំងនេះដោយ៖
១- តាមដានដំណើរការរបស់អង្គការសហប្រជាជាតិលើប្រទេសកម្ពុជានៅលើការផ្សាយបន្តផ្ទាល់ជាផ្លូវការរបស់របស់អង្គការសហប្រជាជាតិ និងតាមរយៈការធ្វើបច្ចុប្បន្នភាពតាមកាលកំណត់របស់យើង។
២- សូមបងប្អូនផ្តល់ទស្សនៈមកក្រុមរបស់យើង ដើម្បីឲ្យយើងបញ្ជូនបន្តទៅអង្គការសហប្រជាជាតិ។
៣- សូមបងប្អូនខិតខំប្រឹងប្រែងធ្វើកិច្ចត្រួតពិនិត្យរៀបចំ និងរបាយការណ៍តាមលទ្ធភាពផ្ទាល់ខ្លួន ដើម្បីពង្រឹង និងបំពេញបន្ថែមការងាររបស់យើង។ សូមចងចាំថា វាគឺជាកិច្ចខិតខំប្រឹងប្រែងរួមរបស់យើង ដែលបាននាំបញ្ហារំលោភយកដីធ្លីនេះត្រឡប់ទៅក្នុងរ៉ាដារបស់អ្នករាយការណ៍ពិសេស និងអង្គការសហប្រជាជាតិវិញ ជាភស្តុតាងពីកិច្ចខិតខំប្រឹងប្រែងតស៊ូមតិរបស់យើង ដែលកំពុងតែធ្វើឱ្យមានភាពខុសប្លែកគ្នាជាវិជ្ជមាននៅលើឆាកអន្តរជាតិ។
