Oral Statement for the Interactive Dialogue with the Special Rapporteur on the situation of human rights in Cambodia

Save Cambodia makes a joint oral statement with the Commission of Inquiry for Cambodia expressing deep concern over the transfer of power in Cambodia from Prime Minister Hun Sen to his son Hun Manet and how it violates domestic and international legal standards and democratic principles.

Item 10: Interactive dialogue with the UN Special Rapporteur on human rights in Cambodia

Something very troubling has taken place involving Cambodia that requires the urgent attention and action of the Human Rights Council and its individual Member States. The unilateral action by Prime Minister Hun Sen to transfer the powers and title of his office to his son Hun Manet is in direct violation of both domestic and international legal standards.

The concerning nature of this action is compounded by the fact that it took place one week after national elections that presumably continued Hun Sen in power, even though the United Nations at the highest levels had indicated that the election could not be considered free, fair or legitimate. This conclusion resulted from a systematic campaign of repression by eliminating the main political opposition, criminally prosecuting and imprisoning opposition leaders and critics through Mass Criminal Trials, closing down independent media outlets, and severely restricting core civil society institutions' free speech and association rights.

The UN, alarmed by these systemic abuses and their impact on electoral fairness and legitimacy, adopted an "Action Plan of Reform Measures" to be implemented before the July 2023 national election can be taken seriously. Instead, the government doubled down on major abuses by transferring power to Hun Manet through his own executive fiat to continue his and his family’s autocratic rule.

We call on the Human Rights Council and its individual Member States to forcefully condemn and reject this latest attempt by the Hun Sen government to destroy the democratic process in Cambodia, guaranteed both by the Cambodian Constitution and the Paris Peace Accords, to select their own leaders, and to live under the principles of democratic governance.

អង្គការ Save Cambodia ធ្វើសេចក្តីថ្លែងការណ៍ផ្ទាល់មាត់រួមគ្នាជាមួយគណៈកម្មការស៊ើបអង្កេតកម្ពុជា ដោយសម្តែងការព្រួយបារម្ភយ៉ាងខ្លាំងចំពោះការផ្ទេរអំណាចនៅកម្ពុជាពីលោកនាយករដ្ឋមន្ត្រី ហ៊ុន សែន ទៅកូនប្រុសរបស់លោក ហ៊ុន ម៉ាណែត និងរបៀបដែលវាបំពានស្តង់ដារច្បាប់ក្នុងស្រុក និងអន្តរជាតិ និងគោលការណ៍លទ្ធិប្រជាធិបតេយ្យ។

ថ្ងៃទី ១១ ខែតុលា ឆ្នាំ ២០២៣ មាន​បញ្ហា​មួយ​យ៉ាង​ខ្លាំង​បាន​កើត​ឡើង​ពាក់ព័ន្ធ​នឹង​ប្រទេស​កម្ពុជា ដែល​ទាមទារ​ឲ្យ​មាន​ការ​យក​ចិត្ត​ទុក​ដាក់​ជា​បន្ទាន់​ពី​ក្រុមប្រឹក្សា​សិទ្ធិ​មនុស្ស និង​រដ្ឋ​សមាជិក​នីមួយៗ។ ចំណាត់ការ​ឯកតោភាគី​របស់​លោកនាយក​រដ្ឋមន្ត្រី ហ៊ុន សែន ក្នុងការ​ផ្ទេរ​អំណាច និង​ឋានន្តរស័ក្តិ​ជូន​កូនប្រុស​លោក ហ៊ុន ម៉ា​ណែ​ត គឺជា​ការបំពាន​ដោយផ្ទាល់​នូវ​ស្តង់ដារ​ច្បាប់​ទាំង​ក្នុង​និង​ក្រៅប្រទេស​។

យើងអំពាវនាវឱ្យក្រុមប្រឹក្សាសិទ្ធិមនុស្ស និងរដ្ឋសមាជិកនីមួយៗ ថ្កោលទោសដោយបង្ខំ និងច្រានចោលការប៉ុនប៉ងចុងក្រោយរបស់រដ្ឋាភិបាល ហ៊ុន សែន ក្នុងការបំផ្លាញដំណើរការប្រជាធិបតេយ្យនៅកម្ពុជា ដែលធានាដោយរដ្ឋធម្មនុញ្ញកម្ពុជា និងកិច្ចព្រមព្រៀងទីក្រុងប៉ារីស ដើម្បីជ្រើសរើសមេដឹកនាំខ្លួនឯង។ និងរស់នៅក្រោមគោលការណ៍នៃអភិបាលកិច្ចតាមបែបប្រជាធិបតេយ្យ។
