White Paper: Upcoming United Nations Advocacy Efforts By And For The Khmer Community
Throughout the past year, in the lead-up to Cambodia’s national elections, the United Nations played the leading role in challenging the Hun Sen government’s long-standing, systemic campaign of major human rights abuses that made free, fair and legitimate elections impossible. Now, they are offering the Khmer community a series of unique advocacy opportunities over the next six months that will allow us to “speak truth to power,” to challenge the legitimacy of Hun Sen’s “hereditary appointment” of his son Hun Manet as his successor, and to demand meaningful and effective change for Cambodia. Join us in these efforts, culminating in a comprehensive review and public hearing on the Hun Sen/Hun Manet government’s human rights and rule of law abuses (the UN’s Universal Periodic Review process (UPR) for Cambodia) in April and May of 2024. This is our, the Khmer people’s best chance to speak out, voice our concerns, and have an impact with the international community on the future of Cambodia.
Here is a list of advocacy events and opportunities that require your attention. Help us by building international pressures needed to promote effective change and progress for Cambodia and the Khmer people starting with:
December 4-14, 2023, when the UN Special Rapporteur, Vitit Muntarbhorn will be making an in-country investigative visit to Cambodia. We will be developing a list of issues and concerns as a framework of his visit for his next report in early 2024. This report will review the latest human rights developments and needs identified by the in-country visit to Cambodia.
January 2024, the UN will be putting out a “Call for Submissions” seeking input from non-governmental groups (NGOs) in connection with the UN progress report on Cambodia that will follow the in-country visit. The ideas we submit will help provide the framework that the United Nations will be using for its next major status report.
April/May 2024, will be the Universal Periodic Review and hearing on Cambodia’s human rights issues before the UN Human Rights Council. This will be the United Nations’ next major evaluation and meeting on Cambodia. It will provide an official public hearing and forum where foreign government members of the UN can and will call Hun Sen to account for Cambodia’s human rights abuses. This is a critical opportunity for the Khmer community to be able to build international pressure that will promote meaningful change.
May 2024, we will be organizing and chairing what is called an “Information Session” side-event, concurrent with the main United Nations UPR Cambodia session. The UN has agreed to help us organize this session, and to get official approval for including it as part of the broader UPR proceedings. This will provide us with a unique opportunity to reach out to the UN Member States and gain their involvement and support for our efforts to promote meaningful change in Cambodia. This is our best chance to speak directly to foreign governments and to get them to impose economic sanctions on the Hun Sen/Hun Manet government, and to use their considerable power to put pressure on the Hun family to make the substantial reforms that are required.
Each of these advocacy efforts provides an opportunity for the Khmer community to get involved in the United Nations’ proceedings regarding Cambodia in a direct and meaningful way. They provide the international forums and platforms that we can use to tell our story – speak truth to power – and demand effective change.
We can cite several recent examples of how we have used similar advocacy opportunities effectively and exerted an important influence on United Nations’ actions. For example, in September of 2023, we filed on behalf of the Khmer community a formal complaint to the UN challenging the legitimacy of Hun Sen’s selection of his son, Hun Manet, as his successor. We pointed to specific provisions of the Cambodia Constitution and international law that were violated by this appointment. Two weeks later, the UN Special Rapporteur led off his formal report on Cambodia to the UN Human Rights Council, indicating the necessity of expressing concerns regarding what the Special Rapporteur referred to as “the hereditary appointment.” In essence, this was a strong indicator of our complaint being heard and acted upon by the UN.
As important, we accompanied the filing of our complaint with the UN with a Khmer Urgent Action Alert on this issue, providing the Khmer community with a sounding board to express their concerns about Hun Manet being appointed successor to Hun Sen outside of the democratic process that was guaranteed by the Paris Peace Accords.
A second example of the power and effectiveness of our advocacy work with the UN is that the Special Rapporteur emphasized in the same report to the UN Human Rights Council on October 9, that a few humanitarian releases of political detainees by Hun Manet were insufficient, echoing our position on this matter. He stressed the necessity for “significant and substantial reforms” that must be made and that are spelled out in the UN “Action Plan of Reform Measures.” His point mirrored our position precisely.
These are a few recent successes showing the effectiveness of our advocacy initiatives that have been driving meaningful and effective change for Cambodia on the international stage.
Throughout the past year, in the run-up to the national elections of July 2023, the UN has been our substantial ally and most important supporter on Cambodia issues. We must continue to work closely with the UN and we must continue to build on the successes thus far. We need to recognize and acknowledge the important work that the UN has been doing on behalf of the Khmer community and provide them with ideas for the next round of reform efforts that need to be initiated at the international level. នេះគឺជាបញ្ជីនៃព្រឹត្តិការណ៍តស៊ូមតិ និងឱកាសដែលត្រូវការការយកចិត្តទុកដាក់របស់អ្នក។ ជួយយើងដោយការកសាងសម្ពាធអន្តរជាតិដែលត្រូវការដើម្បីជំរុញការផ្លាស់ប្តូរប្រកបដោយប្រសិទ្ធភាព និងវឌ្ឍនភាពសម្រាប់កម្ពុជា និងប្រជាជនខ្មែរ ដោយចាប់ផ្តើមពី៖
១- ថ្ងៃទី ៤ - ១៤ ខែធ្នូ ឆ្នាំ ២០២៣ នៅពេលដែលអ្នករាយការណ៍ពិសេសរបស់អង្គការសហប្រជាជាតិ លោក Vitit លោក Muntarbhorn នឹងមកបំពេញទស្សនកិច្ចស៊ើបអង្កេតក្នុងប្រទេសកម្ពុជា។ យើងនឹងបង្កើតបញ្ជីបញ្ហា និងកង្វល់ជាក្របខណ្ឌនៃដំណើរទស្សនកិច្ចរបស់គាត់សម្រាប់របាយការណ៍បន្ទាប់របស់គាត់នៅដើមឆ្នាំ ២០២៤។ របាយការណ៍នេះនឹងពិនិត្យឡើងវិញនូវការអភិវឌ្ឍន៍ និងតម្រូវការសិទ្ធិមនុស្សចុងក្រោយបំផុតដែលកំណត់ដោយដំណើរទស្សនកិច្ចនៅប្រទេសកម្ពុជា។
២- នៅខែមករា ឆ្នាំ ២០២៤ អង្គការសហប្រជាជាតិនឹងដាក់ចេញនូវ "ការអំពាវនាវឱ្យមានការដាក់ស្នើ" ស្វែងរកធាតុចូលពីក្រុមមិនមែនរដ្ឋាភិបាល (NGOs) ទាក់ទងនឹងរបាយការណ៍វឌ្ឍនភាពរបស់អង្គការសហប្រជាជាតិស្តីពីកម្ពុជា ដែលនឹងអនុវត្តតាមដំណើរទស្សនកិច្ចនៅក្នុងប្រទេស។ គំនិតដែលយើងដាក់ជូននឹងជួយផ្តល់នូវក្របខ័ណ្ឌដែលអង្គការសហប្រជាជាតិនឹងប្រើប្រាស់សម្រាប់របាយការណ៍ស្ថានភាពសំខាន់បន្ទាប់របស់ខ្លួន។
៣- ខែមេសា/ឧសភា ២០២៤ នឹងក្លាយជាការត្រួតពិនិត្យជាសកល និងសវនាការលើបញ្ហាសិទ្ធិមនុស្សរបស់កម្ពុជា នៅចំពោះមុខក្រុមប្រឹក្សាសិទ្ធិមនុស្សអង្គការសហប្រជាជាតិ។ នេះជាការវាយតម្លៃ និងកិច្ចប្រជុំសំខាន់បន្ទាប់របស់អង្គការសហប្រជាជាតិស្តីពីកម្ពុជា។ វានឹងផ្តល់នូវសវនាការសាធារណៈ និងវេទិកាដែលសមាជិករដ្ឋាភិបាលបរទេសនៃអង្គការសហប្រជាជាតិអាច ហើយនឹងហៅលោក ហ៊ុន សែន ឲ្យទទួលខុសត្រូវលើការរំលោភសិទ្ធិមនុស្សរបស់កម្ពុជា។ នេះជាឱកាសដ៏សំខាន់សម្រាប់សហគមន៍ខ្មែរដើម្បីអាចបង្កើតសម្ពាធអន្តរជាតិដែលនឹងជំរុញការផ្លាស់ប្តូរដ៏មានអត្ថន័យ។
៤- នៅខែឧសភា ឆ្នាំ ២០២៤ យើងនឹងរៀបចំ និងធ្វើជាប្រធាននូវអ្វីដែលហៅថា "វគ្គព័ត៌មាន" ព្រឹត្តិការណ៍ចំហៀង ដែលស្របគ្នាជាមួយនឹងសម័យប្រជុំដ៏សំខាន់របស់អង្គការសហប្រជាជាតិ UPR Cambodia។ អង្គការសហប្រជាជាតិបានយល់ព្រមដើម្បីជួយយើងរៀបចំសម័យប្រជុំនេះ និងដើម្បីទទួលបានការយល់ព្រមជាផ្លូវការសម្រាប់ការរួមបញ្ចូលវាជាផ្នែកមួយនៃដំណើរការ UPR កាន់តែទូលំទូលាយ។ នេះនឹងផ្តល់ឱ្យយើងនូវឱកាសពិសេសមួយដើម្បីឈានទៅដល់ការចេញទៅកាន់រដ្ឋសមាជិកអង្គការសហប្រជាជាតិ និងទទួលបានការចូលរួម និងការគាំទ្ររបស់ពួកគេសម្រាប់កិច្ចខិតខំប្រឹងប្រែងរបស់យើងក្នុងការលើកកម្ពស់ការផ្លាស់ប្តូរដ៏មានអត្ថន័យនៅក្នុងប្រទេសកម្ពុជា។ នេះជាឱកាសដ៏ល្អបំផុតរបស់យើងក្នុងការនិយាយដោយផ្ទាល់ជាមួយរដ្ឋាភិបាលបរទេស និងដើម្បីឱ្យពួកគេដាក់ទណ្ឌកម្មសេដ្ឋកិច្ចលើរដ្ឋាភិបាល ហ៊ុន សែន/ហ៊ុន ម៉ាណែត និងប្រើប្រាស់អំណាចដ៏សន្ធឹកសន្ធាប់របស់ពួកគេដើម្បីដាក់សម្ពាធលើគ្រួសារ ហ៊ុន ដើម្បីធ្វើកំណែទម្រង់សំខាន់ៗដែលត្រូវការ។
រាល់កិច្ចខិតខំប្រឹងប្រែងតស៊ូមតិទាំងនេះផ្តល់ឱកាសសម្រាប់សហគមន៍ខ្មែរក្នុងការចូលរួមក្នុងដំណើរការរបស់អង្គការសហប្រជាជាតិទាក់ទងនឹងប្រទេសកម្ពុជាដោយផ្ទាល់ និងប្រកបដោយអត្ថន័យ។ ពួកគេផ្តល់វេទិកា និងវេទិកាអន្តរជាតិដែលយើងអាចប្រើដើម្បីប្រាប់រឿងរបស់យើង - និយាយការពិតដើម្បីអំណាច - និងទាមទារការផ្លាស់ប្តូរប្រកបដោយប្រសិទ្ធភាព។

ជាការសំខាន់ យើងបានភ្ជាប់ជាមួយការដាក់ពាក្យបណ្ដឹងរបស់យើងទៅអង្គការសហប្រជាជាតិ ជាមួយការដាស់តឿនសកម្មភាពបន្ទាន់របស់ខ្មែរលើបញ្ហានេះ ដោយផ្តល់ឱ្យសហគមន៍ខ្មែរនូវក្រុមប្រឹក្សាសំឡេង ដើម្បីបង្ហាញពីកង្វល់របស់ពួកគេចំពោះលោក ហ៊ុន ម៉ាណែត ដែលត្រូវបានតែងតាំងជាអ្នកស្នងតំណែងពីលោក ហ៊ុន សែន នៅក្រៅដំណើរការ លទ្ធិប្រជាធិបតេយ្យ ។ ត្រូវបានធានាដោយកិច្ចព្រមព្រៀងទីក្រុងប៉ារីស។
ឧទាហរណ៍ទីពីរនៃអំណាច និងប្រសិទ្ធភាពនៃការងារតស៊ូមតិរបស់យើងជាមួយអង្គការសហប្រជាជាតិ គឺអ្នករាយការណ៍ពិសេសបានគូសបញ្ជាក់នៅក្នុងរបាយការណ៍ដូចគ្នាទៅកាន់ក្រុមប្រឹក្សាសិទ្ធិមនុស្សអង្គការសហប្រជាជាតិកាលពីថ្ងៃទី ៩ ខែតុលា ថា ការដោះលែងអ្នកជាប់ឃុំផ្នែកនយោបាយមួយចំនួនដោយមនុស្សធម៌ដោយលោក ហ៊ុន ម៉ាណែត មិនគ្រប់គ្រាន់ ទេ ។ ជំហររបស់យើងលើបញ្ហានេះ។ លោកបានសង្កត់ធ្ងន់លើភាពចាំបាច់សម្រាប់ "កំណែទម្រង់សំខាន់ៗ និងសំខាន់" ដែលត្រូវតែធ្វើ ហើយដែលត្រូវបានសរសេរនៅក្នុង "ផែនការសកម្មភាពនៃវិធានការកំណែទម្រង់" របស់អង្គការសហប្រជាជាតិ។ ចំណុចរបស់គាត់បានឆ្លុះបញ្ចាំងពីជំហររបស់យើងយ៉ាងជាក់លាក់។

ពេញមួយឆ្នាំកន្លងមក ក្នុងការបោះឆ្នោតជាតិខែកក្កដា ឆ្នាំ២០២៣ អង្គការសហប្រជាជាតិ គឺជាសម្ព័ន្ធមិត្តដ៏សំខាន់របស់យើង និងជាអ្នកគាំទ្រដ៏សំខាន់បំផុតលើបញ្ហាកម្ពុជា។ យើងត្រូវតែបន្តធ្វើការយ៉ាងជិតស្និទ្ធជាមួយអង្គការសហប្រជាជាតិ ហើយយើងត្រូវតែបន្តកសាងនូវភាពជោគជ័យរហូតមកដល់ពេលនេះ។ យើងត្រូវទទួលស្គាល់ និងទទួលស្គាល់ការងារសំខាន់ៗដែលអង្គការសហប្រជាជាតិបាននិងកំពុងធ្វើក្នុងនាមសហគមន៍ខ្មែរ ហើយផ្តល់ជាគំនិតដល់ពួកគេសម្រាប់កិច្ចខិតខំប្រឹងប្រែងកំណែទម្រង់បន្ទាប់ ដែលចាំបាច់ត្រូវផ្តួចផ្តើមនៅកម្រិតអន្តរជាតិ។ យើងនឹងបន្តណែនាំអ្នកអំពីអ្វីដែលកំពុងកើតឡើង និងរបៀបដែលអ្នកអាចចូលរួមយ៉ាងសកម្មនៅលើមូលដ្ឋានដែលកំពុងបន្ត។ សូមរង់ចាំសម្រាប់ការចេញផ្សាយព័ត៌មានបន្ទាប់របស់យើង។
